Melbourne Weight Loss Surgery Retreat | “The Reconnect Retreat”
These terms and conditions serve as an agreement between:
Melbourne Gastro Oesophageal Surgery Service Trust (also operating under the name “Melbourne Weight Loss Surgery” and “Weight Loss Surgery Support” which can be used interchangeably within these terms).
AND
Attendees/guests of Melbourne Weight Loss Surgery’s event.
This agreement is considered read, understood and accepted once the Guest has paid the initial deposit required for Melbourne Weight Loss Surgery’s retreat event (The Reconnect Retreat).
Event Booking
A booking for the Reconnect Retreat is confirmed when your deposit of $500.00 is paid.
We recommend that all guests obtain their own travel insurance once their booking is confirmed - insurance to cover all medical expenses, retreat activities, and a trip cancellation policy in the unlikely event that the retreat is canceled or in case of a personal emergency that will prevent you from attending (however this is not compulsory and is up to each individual)
Payment Policy
Payment must be received in full and must be made 90 days prior to the retreat commencement (due 17/02/2024) unless otherwise authorised by Melbourne Weight Loss Surgery.
If a retreat booking is made within 90 days of the retreat commencement, the full fee including deposit must be paid upfront in full.
If payment of the balance is not received by the due date the Host reserves the right to cancel the reservation and retain the deposit.
The guest is responsible for paying for all extra services not included in the retreat package. This includes if applicable flights, transfers, travel insurance, and any sightseeing activities that are not part of the retreat program.
Payments by credit card that incur a service fee are to be paid by the guest.
Cancellation Policy
It is the responsibility of the guest to read and understand the cancellation policy before making a reservation.
In the event of cancellation by the guest, regardless of the circumstances, the following cancellation fees apply:
o The deposit is non-refundable under all circumstances
o Cancellation less than 60 days prior to the retreat commencement (18/03/2024), Melbourne Weight Loss Surgery retains 100% of the fee in addition to the deposit amount
o Cancellation less than 90 days prior to the retreat commencement (17/02/2024), Melbourne Weight Loss Surgery retains 50% of the total fee in addition to the deposit amount
o Cancellation with more than 90 days of notice (prior to 17/02/2024), Melbourne Weight Loss Surgery retains the deposit amount only ($500.00)
We do not offer credit for a guest arriving late or leaving early under any circumstances. This includes unforeseen issues such as family-related illness, or COVID diagnosis.
Melbourne Weight Loss Surgery reserves the right to cancel the retreat and retain the deposit fee if 8 attendees have not paid in full on or after 18/03/2024.
Melbourne Weight Loss Surgery reserves the right to change its location due to unforeseen issues (e.g. third-party delays or problems, construction, etc.). Melbourne Weight Loss Surgery will aim to maintain a similar standard of quality in all the partnering locations.
Melbourne Weight Loss Surgery reserves the right to change or amend this policy at any time. The current policy is always applicable.
Liability
Melbourne Weight Loss Surgery shall not be liable for any unusual and unforeseeable circumstances beyond our normal control, which the consequences of could not have been avoided even when exercising all due care. Such circumstances or events include, but are not limited to, pandemic outbreak, war or threat of war, riot, civil unrest, industrial disputes or strikes, accidents or failure to perform by third parties, including suppliers and subcontractors, unavoidable technical problems with the accommodation, transport or closure or congestion of airports, terrorist activity, natural disasters, industrial disasters, fire, theft, flooding and adverse weather conditions. In the event of any the above, refunds and compensation payments cannot be made.
Melbourne Weight Loss Surgery accepts no liability for loss, damage, injury, illnesses or death which may occur during the guest’s stay, during activities included in the retreat whether on the retreat site or elsewhere, or travelling to and from the Melbourne Weight Loss Surgery retreat.
Melbourne Weight Loss Surgery is not liable for any injuries or losses to guests, in the use of retreat facilities or participation in activities.
While all care is taken, Melbourne Weight Loss Surgery cannot accept any responsibility for loss or damage of personal possessions or valuables of guests.
All guests must take responsibility for their own medical and physical fitness and ability to use retreat facilities and participate in activities.
The guest agrees that they are not to engage in any illegal activity whilst attending the retreat or bring prohibited items to the retreat (such as alcohol, drugs, weapons of any kind, sharp objects, certain flammable substances) and that Melbourne Weight Loss Surgery reserves the right to remove the guest from the retreat premises and retain 100% of the guest’s attendance fee.
Melbourne Weight Loss Surgery reserves the right to remove the guest from the retreat premises and retain 100% of the guest’s attendance fee in the case that the guest poses a risk to the health, safety and wellbeing of themselves, the hosts and/or the other guests as determined by the hosts.
Data Use and Protection
The guest agrees that they may be photographed and/or filmed during their stay and/or activities in connection with Melbourne Weight Loss Surgery, and also agrees that the company may use such recordings for promotion and/or advertising purposes without any prior consent.
Melbourne Weight Loss Surgery assumes all rights to any media obtained, including but not exclusive to, video recording, audio recording, written testimonials and images.
Guests may not request any form of payment or compensation for Melbourne Weight Loss Surgery’s use of any media obtained.
Intellectual Property
Any materials, resources and information obtained at the retreat are the intellectual property of Melbourne Weight Loss Surgery. The guest agrees that they will not a) alter or modify materials; b) create derivative works from the materials; or c) use our materials for commercial purposes such as selling to third parties without written permission from Melbourne Weight Loss Surgery
